General Terms and Conditions (GTC)

1. Scope

These GTC apply to all digitisation orders placed with murmy GmbH (hereinafter the "Provider") via the website plaene-scannen.ch or by other means. Differing conditions of the customer apply only if the Provider expressly agrees to them in writing.

2. Order and conclusion of contract

The order placed via the online form constitutes an offer to contract by the customer. The contract is concluded upon the Provider's order confirmation by email. The amounts shown in the price calculator and in the order are guide prices based on the customer's details; the definitive price is confirmed after receipt of the goods and inspection of quantity and condition. In the event of material discrepancies, the Provider consults the customer before proceeding.

3. Customer's obligations

The customer ensures that they are entitled to digitise the documents submitted and that no third-party rights are infringed. Dispatch to the Provider is at the customer's cost and risk; transport-secure packaging in accordance with the Provider's instructions is required.

4. Service and delivery time

The Provider digitises the documents with the care of a professional scanning service provider. The processing time depends on the quantity and condition of the originals and is confirmed after receipt of the goods; any time frame stated is a guideline period and not a fixed deadline. The files are delivered by download link, and for large volumes of data on a data carrier by arrangement.

5. Originals

Once the order is completed, the originals are returned by insured dispatch to the address provided; the return dispatch flat fee is shown in the price. At the customer's express request, the Provider instead undertakes the proper, confidential destruction.

6. Prices and payment

The prices published at the time of the order apply, plus statutory value added tax. Payment is made after delivery by invoice with a term of 30 days net. In the event of late payment, the Provider may charge default interest as well as reminder fees in accordance with the statutory provisions.

7. Notice of defects

The customer inspects the delivered files within 14 days and reports any defects in writing. In the case of justified defects, free rectification takes place (re-scan of the affected documents); further claims exist within the scope of clause 8.

8. Liability

The Provider is liable for damage caused intentionally or through gross negligence. Liability for slight negligence as well as for indirect and consequential damage (e.g. lost profit, data loss on the customer's side) is excluded, to the extent permitted by law. For transport damage on the return journey, the Provider is liable to the extent of the transport insurance. In the case of irreplaceable one-of-a-kind items, the Provider recommends declaring the value before dispatch and agreeing on increased insurance cover.

9. Confidentiality and data protection

The Provider treats all submitted documents and generated data as confidential and processes them solely to fulfil the order. Scan data is deleted 30 days after delivery. In all other respects, the privacy policy applies.

10. Final provisions

Swiss law applies. The place of jurisdiction is the registered office of the Provider, unless mandatory statutory places of jurisdiction apply. Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
